PUBLIC NOTICE Pursuant to 42 CFR ? 447.205, the Oklahoma Health Care Authority (OHCA) is required to give public notice of any significant proposed changes to its methods and standards for setting payment rates for services. The below changes are effective April1, 2010. Changes are necessary to reduce the Agency's operations budget by 10% directed by the State Treasurer in order to balance the state budget in accordance with Article 10, Section 23 of the Oklahoma Constitution. The changes were approved by the OHCA Board of Directors at its regular scheduled meetings held December 10, 2009 in Tulsa Oklahoma, January 14, 2010 in Oklahoma City and February 11, 2010 in Oklahoma City. Cost Sharing SoonerCare member´s copay will be increased for the following provider groups: (1) inpatient hospital will increase from $3.00 to $10.00 per day with a cap of $90.00; (2) adult behavioral health will increase from zero to $3.00 per visit; (3) home health will increase from $1.00 to $3.00 per visit; (4) DME will increase from zero to $3.00 per visit; (5) pharmacy will increase from $1.00 to $2.00 for prescriptions having a Medicaid allowable of $29.99 or less, increase from $2.00 to $3.00 for prescriptions having a Medicaid allowable of $30.00 or more and preferred generics will decrease to a zero co-pay; (6) physician and other practitioner services will increase from $1.00 to $3.00 per visit; (7) rural health clinic services will increase from $1.00 to $3.00 per visit; (8) federally qualified health center services will increase from $1.00 to $3.00 per visit; and (9) Medicare Part B crossover claims will increase from $.50 to $1.00 per visit. These changes are estimated to decrease annual expenditures by $2,453,578 (federal and state). Provider Payment Changes Across-the-Board Rate ReductionsOHCA will reduce provider payments by 3.25% across the board to contracted providers. Provider types include but are not limited to the following: Physicians; Hospi talsInpatient Services, Outpatient Services, PRTF´s, Children´s Long Term Care Sub-Acute Hospitals, Freestanding Rehabilitation Hospitals; Sooner Choice ManagementCare Coordination Services, Incentive Payments; Other Providers-Other Practitioners (i.e. podiatrist, chiropractor), Home Health Care Services; Lab and Radiology Services; Ambulatory Clinics; Nursing FacilitiesNurs ing Facilities, Acute Care ICF´s/MR, ICF´s/MR, Aids Facilities, Ventilator Add on Rates; Dentist; Behavioral Health Rehab; DME; PharmacyPharmacy Dispensing Fees, Injectable Drugs; Maternal and Child Health services. These changes are estimated to decrease annual expenditures by $13,271,195 (federal and state). Durable Medical Equipment (DME)Diabetic supplies will be adjusted to reflect a 40% reduction from the Medicare allowable. Capped rental items will be reduced 10% from the rates published for January 1, 2010. The new rate compares to a Medicare accumulated rate. The new OHCA rate is 90% of the Medicare allowable. These changes are estimated to decrease annual expenditures by $61,850 (federal and state). Freestanding End Stage Renal Diseases FacilitiesOHCA will reduce the Medicaid allowable for Medicare Part A & Part B crossover claims from 100% of the Medicaid allowable for coinsurance (part B) and deductibles (part A) to 25% of the Medicaid allowable for co-insurance and 75% of the Medicaid allowable for deductibles. These changes are estimated to decrease annual expenditures by $982,461 (federal and state). PharmacyFor multiple source products, OHCA is proposing to change the calculation methodology for the State Maximum Allowable Cost to a proprietary calculation provided by a contractor based on products available from wholesalers in Oklahoma. These changes are estimated to be budget neutral. Psychiatric Residential Treatment Facilities Effective for admissions on and after April 1, 2010, the OHCA is proposing to change the payment methodology for inpatient psychiatric residential treatment services for individuals under the age of 21 provided by psychiatric hospitals, psychiatric units of medical/surgical hospitals and psychiatric residential treatment facilities (PRTFs). The proposed change is to implement a tiered reimbursement system that reduces the per diem for longer lengths of stay, in order to encourage discharge planning to less restrictive environments. The OHCA is also proposing an increase to the current rate for services defined as ?community-based transitional? (CBT) programs from $190.97 per day to $220 per day. The proposed tiered rates for all residential programs are calculated after the standard overall reduction of 3.25% is made to the current base rates. These changes are estimated to decrease annual expenditures by $7,800,000 (federal and state). U.S. Environmental Protection Agency Notice of Opportunity for Public Comment and Public Hearing STATE OF OKLAHOMA REVISES ITS APPROVED PUBLIC WATER SYSTEM SUPERVISION PRIMACY PROGRAM The United States Environmental Protection Agency (EPA) is announcing its tentative decision to approve some recent revisions to Oklahoma´s primacy program. Notice is hereby given in accordance with the Safe Drinking Water Act as amended, and 40 CFR ?142, the National Primary Drinking Water Regulations Implementation, that the State of Oklahoma has revised its approved Public Water System Supervision Primacy Program. This is the program which oversees drinking water facilities in Oklahoma. Specifically, Oklahoma has adopted the Lead and Copper Rule (LCR) Short-Term Regulatory Revisions and Clarifications to strengthen the implementation of the LCR for more effective protection of public health by reducing exposure to lead in drinking water. EPA has determined that these revisions submitted by Oklahoma are no less stringent than the corresponding federal regulations. Therefore, EPA proposes to approve these program revisions. All interested parties are invited to submit written comments on this decision and may request a public hearing. Comments or a request for a public hearing must be submitted by April 5, 2010 to the Regional Administrator at the EPA Region 6 address shown below. All comments will be considered, and, if necessary, EPA will issue a response. Frivolous or insubstantial requests for a hearing may be denied by the Regional Administrator. However, if a substantial request for a public hearing is made by April 5, 2010, a public hearing will be held. If no timely and appropriate request for a hearing is received and the Regional Administrator does not elect to hold a hearing on his own motion, and if no comments are received which cause EPA to modify its tentative approval, this determination shall become effective on April 5, 2010. Farm Service Agency (FSA) administers the CRP on behalf of the CCC. The Final EA assesses the potential environmental impacts associated with changing managed haying and grazing frequencies and the associated Primary Nesting Season (PNS) dates. FSA has determined that their chosen alternative will not have significant impacts on the quality of the human environment and therefore will not prepare an Environmental Impact Statement (EIS). FSA is accepting comments on the Final EA and FONSI for a period of 30 days from February 26th, 2010. Unless new, substantial issues or alternatives are identified, the new decision/FONSI will take effect after the close of the comment period.
